1. Agreement to Terms

These Terms of Service ("Terms") form an agreement between you and Zpply ("Zpply," "we," "us," or "our"). By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of them, you may not access the Service.

2. Description of Service

Zpply is a job application automation platform that helps users:

• Automate job applications across multiple platforms (LinkedIn, Naukri, Instahyre)
• Track application status and responses
• Optimize resume and cover letter submissions
• Receive job recommendations based on preferences

3. User Accounts and Registration

3.1 Account Creation

To use our Service, you must create an account using Google or LinkedIn OAuth. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Responsibility

• You must provide accurate, complete, and current information
• You are responsible for all activities under your account
• You must notify us immediately of any unauthorized access
• You must be at least 18 years old to use our Service

4. Acceptable Use Policy

4.1 Permitted Uses

You may use our Service for legitimate job search activities only.

4.2 Prohibited Activities

You agree NOT to:

• Violate any laws or regulations
• Submit false, misleading, or fraudulent information
• Spam or harass employers or other users
• Attempt to reverse engineer or hack our platform
• Use automated tools other than our authorized automation
• Violate terms of service of integrated job platforms
• Share your account credentials with others
• Use our Service for any commercial purpose without authorization

5. Job Application Automation

5.1 Authorization

By using our automation features, you explicitly authorize Zpply to:

• Access your connected job portal accounts
• Submit job applications on your behalf
• Upload your resume and cover letters
• Fill out application forms using your profile information

5.2 User Responsibility

• You are responsible for the accuracy of all submitted information
• In Review mode, Zpply submits an application only after you approve it. If you enable Auto mode, you authorise Zpply to submit applications that meet the preferences, rules and limits you set. You may switch modes or pause Auto mode at any time.
• You acknowledge that automation may have limitations
• You agree to comply with each job platform's terms of service

6. Intellectual Property Rights

6.1 Our Intellectual Property

The Service and its content, features, and functionality are owned by Zpply and are protected by intellectual property laws.

6.2 Your Content

You retain ownership of your resume, portfolio, and other content you upload. By using our Service, you grant us a license to use this content for providing our services.

7. Privacy and Data Protection

To run the Service we handle your profile details, résumés, employment and salary information, the answers you give to application questions, and a connection to each job portal you choose to link.

We do not ask for or store your job portal password. You sign in on each portal's own login page. To provide connected features we store an encrypted session token, which we delete when it expires or when you disconnect that portal. Copies may persist briefly in security logs and backups before they are overwritten on their normal cycle.

You may access, correct, export or delete your data, and withdraw consent, by writing to us. Full details of what we collect, why, who receives it and how long we keep it are in our Privacy Policy, which is incorporated into these Terms by reference.

8. Payment Terms

8.1 Subscription Plans

Your first 10 applications are free. The allowance applies once to your account in total and does not reset weekly or per connected portal. After it is used, continued use requires a paid plan, and the current price and application limits are shown on our website. Prices may change with notice, and a change never applies to a billing period you have already paid for.

8.2 Billing and Refunds

• Paid plans are billed in advance for each billing period
• Paid plans renew automatically until you cancel. You will be told the renewal date and amount before each renewal
• Whether taxes are included is stated at checkout before you pay
• You may cancel at any time from your account or by writing to us, and access continues to the end of the period you have paid for
• Payments are non-refundable except where required by law, where we end a paid account without fault on your part, or where a paid feature is materially reduced
• If a payment fails we will tell you and may suspend paid features until it succeeds. Your data is not deleted for a failed payment alone

9. Service Availability and Modifications

9.1 Service Availability

While we strive for high availability, we do not guarantee that our Service will be uninterrupted or error-free. We may experience downtime for maintenance or technical issues.

9.2 Modifications

We reserve the right to modify, suspend, or discontinue any part of our Service. Where a change materially reduces a paid feature, we will give notice where practical and you may cancel and request a refund of the unused portion of your current billing period.

10. Disclaimers and Limitations of Liability

10.1 Service Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10.2 Job Application Results

We do not guarantee that use of our Service will result in job interviews, offers, or employment. Success depends on many factors beyond our control.

10.3 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ZPPLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE.

11. Indemnification

You agree to indemnify Zpply against claims, damages and reasonable expenses caused by: information you supply that is false or unlawful; your material breach of these Terms; infringement caused by content you upload; or your fraudulent or unlawful use of the Service.

12. Termination

12.1 Termination by You

You may terminate your account at any time by contacting us or using account deletion features.

12.2 Termination by Us

We may suspend or terminate your access for a material breach of these Terms. We will give reasonable notice where practical, and may act immediately where required to address fraud, a security risk, illegality or abuse. If we end a paid account without fault on your part, we will refund the unused portion of your current billing period.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India. The parties will first attempt to resolve any dispute in good faith. Any dispute that may lawfully be referred to arbitration will be resolved under the Arbitration and Conciliation Act, 1996, by one arbitrator, in English, with the seat of arbitration in Bengaluru, Karnataka. Nothing in this section limits any right available to you under applicable consumer law.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes by email or through our platform. Continued use of the Service after changes constitutes acceptance of the new Terms.
